General Terms and Conditions of Sale

Preamble

These general conditions of sale are agreed between Kosmotec - Tecnologias de Informação e Comunicação, sole proprietorship of José Lopes Silva Vieira, headquartered at Rua Irmãs Paulas nº 60, Vila Moreira - Alcanena, holder of VAT number 116795344, and any natural or legal person placing orders through the website https://kosmotec.com/, hereinafter referred to as the User.

Article 1 – Object

This document regulates the conditions applicable to the order, sale, payment, and delivery of products sold on the aforementioned website.

Article 2 – Order

The User may place orders after adding products to the "Shopping Cart" and completing the following steps:

a) Registration on the website providing real, complete, and updated data.

b) Login with the email and password defined during registration.

c) Complete the information regarding delivery, billing, shipping, and payment.

Submission confirms acceptance of the current prices and conditions.

Article 3 – Delivery Times, Shipping, and Cancellations

1. The deadlines indicated in the order consider production and transport, expressed in business days, with a maximum period of 30 days unless otherwise agreed in writing.

2. Kosmotec strives to dispatch items within 2 to 5 business days after confirmation.

3. The User must inform in advance about delivery restrictions.

4. Ownership passes to the client after acceptance of the goods by the carrier.

5. For tracking, the client can contact geral@kosmotec.com or phone +351 962 467 174, from 10 am to 6 pm, Monday to Friday.

6. Cancellations must be requested in writing and approved by Kosmotec. Charges incurred up to that point may be billed to the User.

Article 4 – Guarantees and Returns

Guarantees

New products benefit from a three-year legal guarantee, under Portuguese legislation. All transport costs related to the guarantee are the responsibility of the User.

Returns

Returns sent with postage due or cash on delivery are not accepted; return costs are exclusively the User's responsibility.

The return request must be made within a maximum of 14 days after delivery, and the product must be in perfect condition, unused, and with intact packaging.

Personalized products, manufactured according to the User's specific specifications, are not eligible for return, except in the case of a proven defect.

Article 5 – Prices

Prices are expressed in Euros and include legally applicable taxes. The prices indicated in the "Shopping Cart" are valid until final confirmation of the order, subject to availability.

Article 6 – Payment

Proof of payment must be sent to geral@kosmotec.com, identifying the order. Non-confirmation within 24-48 hours may result in cancellation.

Article 7 – Invoicing

Invoices accompany the order in paper format; the User may opt for digital delivery to their email, in accordance with current electronic invoicing legislation. Specific preferences will be accommodated.

Article 8 – Promotions

Current promotions are listed on specific product pages and apply after payment confirmation. Simply reserving in the cart does not guarantee promotional prices.

Article 9 – VAT Exemption

Clients domiciled or established in a European Union country, duly registered in VIES (VAT Information Exchange System), are invoiced without VAT, provided they supply a valid tax identification number. Responsibility for declaring and paying the tax lies with the recipient of the goods in their country of origin.

Clients outside the European Union or without a valid VIES registration are invoiced with VAT according to current Portuguese legislation.

Article 10 – Contractual Liability

Kosmotec assumes no responsibility for breaches resulting from force majeure, natural events, strikes, or communication failures. It is not responsible for damages caused by the improper use of the Internet or the purchased products.

Article 11 – Personal Data Processing

The User consents to the automated processing of their data for the fulfillment of contractual obligations. Check our Privacy Policy.

Article 12 – Advertising

The sending of promotional communications depends on the User's consent, which can be revoked at any time.

Article 13 – Intellectual Property

All website content belongs to Kosmotec and partners. Its reproduction, even partial, depends on prior authorization. Placing links does not constitute any partnership.

Article 14 – Applicable Law and Jurisdiction

These conditions are governed by Portuguese legislation. The competent court is located in the district of Alcanena/Torres Novas for emerging disputes.
